ICAO COUNCIL TAKES DECISION ON IR655 INVESTIGATION REPORT
Montreal, December 1988 -- On t h e b a s i s of t h e summary of i t s P r e
s i d e n t , D r . Assad K o t a i t e , t h e ICAO Council a t t h e 14th
Meeting (Closed) of t h e 125th Session on 7 December 1988, took t h e
following d e c i s i o n :
TНE COUNCIL:
1. Recalled i t s c c i s i o n of 14 J u l y 1988 adopted a t i t s
Extraordinary Session i n Montreal concerning t h e shooting down, on 3 J u l
y 1988, of I r a n A i r Airbus A300 on f l i g h t IR655;
2. Received t h e Report of t h e fact-finding i n v e s t i g a t i o n i n s
t i t u t e d by t h e Secretary General pursuant t o t h a t decision of t h
e ICAO Council;
3 . Recognized with appreciation t h a t a l l p a r t i e s concerned
cooperated f u l l y i n t h i s i n v e s t i g a t i o n ;
4. Expressed again i t s profound r e g r e t over t h e l o s s of 290 l i v
e s and i t s deep sympathy and condolences t o t h e Government of t h e
Islamic Republic of I r a n and t o t h e bereaved f a m i l i e s of t h e
victims of t h i s t r a g i c event;
5. Urged a l l S t a t e s t o t a k e a l l necessary a c t i o n f o r t h e
s a f e t y of navigation of c i v i l a i r c r a f t , p a r t i c u l a r l
y by assuring e f f e c t i v e co-ordination of c i v i l and m i l i t a r y
a c t i v i t i e s ;
6. Reaffirmed again t h e fundamental p r i n c i p l e of general i n t e r n
a t i o n a l l a w t h a t S t a t e s must r e f r a i n from r e s o r t i
n g t o t h e u s e of weapons a g a i n s t c i v i l a i r c r a f t ;
7. Appealed urgently t o a l l S t a t e s which have not yet done so t o r a
t i f y , as soon as p o s s i b l e , t h e Protocol introducing A r t i c l
e 3 - b i s i n t o t h e Convent ion on I n t e r n a t i o n a l C i v i l
Aviation;*
8. I n s t r u c t e d t h e ICAO A i r Navigation Commission t o study t h e
s a f e t y recommendations contained i n t h e Report of t h e fact-f inding
i n v e s t i g a t i o n and t o r e p o r t t o t h e 126th Session of t h e
Council on any measures i t considers necessary so a s t o prevent t h e
recurrence of a similar t r a g i c event;
9. Directed t h e A i r Navigation Commission t o examine, upon i t s
completion, t h e r e s u l t s of t h e s t u d i e s already undertaken f o
r t h e improvement of t h e Standards and Recommended P r a c t i c e s a s d
i r e c t e d by t h e Council i n i t s decision on 14 July 1988;
10. Decided t h a t t h e Report of t h e fact-finding i n v e s t i g a t i o
n no longer has a r e s t r i c t e d c h a r a c t e r ; and
11. Decided t o include t h e Report of i n v e s t i g a t i o n as required
i n t h e Council decision of 14 July 1988 i n t h e Work Programme of t h e
126th Session of t h e Council (February-March 1989).

1984
