From: "Alexis Nekrassov" <SjudaNePishi@sfr.fr> ICAO COUNCIL TAKES FINAL ACTION ON KOREAN AIR LINES INCIDENT Montreal, 6 March 1984 -- The Council of ICAO a t t h e c l o s e of i t s debate on t h e r e p o r t of t h e i n v e s t i g a t i o n by t h e Secretary General r e l a t i n g t o t h e d e s t r u c t i o n of Korean A i r Lines (KAL) f l i g h t 007 on 1 September 1983 by Soviet m i l i t a r y a i r c r a f t , adopted t h e following r e s o l u t i o n : TНE COUNCIL, 1 ) RECALLING t h e resolutions adopted and t h e decisions taken on 16 September 1983 a t t h e Extraordinary Session of t h e ICAO Council and endorsed by the 24th Session of t h e ICAO Assembly i n October 1983 a s w e l l as 'the Council Resolution of 13 December 1983, r e l a t i n g t o the destruction of a Korean Air Lines c i v i l a i r c r a f t on 1 September 1983 by Soviet m i l i t a r y allrcraft; 2) НAVING CONSIDERED t h e report of the investigation by t h e Secretary General and t h e subsequent technical review by t h e A i r Navigation Commission; 3) RECOGNIZING t h a t , although' t h i s i n v e s t i g a t i o n was unable, because of l a c k of necessary d a t a , t o determine conclusively t h e p r e c i s e cause f o r t h e s e r i o u s d e v i a t i o n of some 500 kilometers from i t s f l i g h t plan r o u t e by t h e Korean a i r c r a f t i n t o t h e a i r s p a c e above t h e t e r r i t o r y under t h e sovereignty of t h e Soviet Union, no evidence w a s found t o i n d i c a t e t h a t t h e deviation w a s premeditated or t h a t t h e crew was a t any time aware of t h e f l i g h t ' s d e v i a t i o n ; 4) REAFFIRMING t h a t , whatever t h e circumstances which, according t o t h e Secretary General's report, may have caused t h e a i r c r a f t t o s t r a y off its f l i g h t plan route, such' use of armed f o r c e c o n s t i t u t e s a v i o l a t i o n of i n t e r - n a t i o n a l law, and invokes generally recognized l e g a l consequences; 5 ) RECGGNIZING t h a t such use of armed f o r c e is a grave t h r e a t t o t h e s a f e t y of i n t e r n a t i o n a l c i v i l aviation, and is inccmpatible with t h e norms governing i n t e r n a t i o n a l behavior and with t h e r u l e s , Standards and Recommended Prac- t i c e e enshrined in t h e Chicago Convention and its Annexes and with elemen- t a r y consideration of humanity; 6 ) EXPRESSING its continuing sympathy with t h e families bereaved i n t h i s t r a g i c incident; I) CONDEMNS t h e u s e of armed f o r c e which r e s u l t e d i n t h e d e s t r u c t i o n of t h e Korean a i r l i n e r and t h e t r a g i c loss of 269 l i v e s ; 2) DEEPLY DEPLORES t h e Soviet f a i l u r e t o cooperate in t h e s e a r c h and rescue e f f o r t s of o t h e r involved S t a t e s and t h e Soviet f a i l u r e t o cooperate with t h e ICAO i n v e s t i g a t i o n of t h e i n c i d e n t by refusing t o accept t h e v i s i t of t h e i n v e s t i g a t i o n team appointed by t h e Secretary General and by f a i l i n g so f a r t o provide t h e Secretary General with informa- t i o n relevant t o t h e Investigation; 3) URGES a l l Contracting S t a t e s t o cooperate f u l l y in t h e work of examining and adopting an amendment t o t h e Chicago Convention a t t h e 25th Session (Extraordinary) of t h e ICAO Assembly and in t h e improvement of measures f o r preventing a recurrence of t h i s type of tragedy . The Council i n reaching i t s decision had before i t n o t only t h e r e p o r t by t h e Secretary General on t h e f a c t s and t e c h n i c a l a s p e c t s r e l a t i n g t o t h e f l i g h t and destruction of t h e a i r c r a f t but t h e t e c h n i c a l comments by t h e A i r Navigation Commission ( A N C ) , as p a r t of i t s ongoing study of appropriate annexes and documents r e l a t e d t o i n t e r c e p t i o n of c i v i l a i r c r a f t . This study has r e s u l t e d i n a series of s a f e t y recommendations and proposed amendments t o t h e r e l e v a n t annexes which w i l l be r e f e r r e d t o t h e Council f o r a c t i o n a f t e r they have been reviewed by States. The Council previously decided t o convene t h e Extraordinary Session of t h e Assembly of 152 Contracting S t a t e s on 24 A p r i l 1984, t o consider proposed amendments t o t h e Convention on I n t e r n a t i o n a l C i v i l Aviation t h a t would assure t h a t S t a t e s a b s t a i n from t h e use of f o r c e a g a i n s t c i v i l a i r c r a f t .
