DECISION TAKEN BY ICAO COUNCIL ON IR655 TRAGEDY
Montreal, 1 7 March 1989 -- The ICAO Council today adopted t h e following
r e s o l u t ion:
TНE ICAO COUNCIL,
Recalling i t s decisions of 14 J u l y and 7 December 1988 concerning t h e
shooting down, on 3 J u l y 1988, of I r a n A i r Airbus 300 on f l i g h t
IR655 by a warship of t h e United S t a t e s ;
Нaving considered t h e r e p o r t of t h e fact-f inding i n v e s t i g a t
i o n i n s t i t u t e d by t h e Secretary General pursuant t o t h e
decision of t h e Council of 14 J u l y 1988 and t h e subsequent study by t h
e A i r Navigation Commission of t h e s a f e t y recommendations presented i
n t h a t r e p o r t ;
Expressing appreciation f o r t h e f u l l co-operation extended t o t h e
fact-f inding mission by the. a u t h o r i t i e s of a l l S t a t e s
concerned;
Recalling t h a t t h e 25th Session (Extraordinary) of t h e Assembly i n
1984 unanimously recognized t h e duty of S t a t e s t o r e f r a i n from t
h e u s e of weapons a g a i n s t c i v i l a i r c r a f t i n f l i g h t ;
Reaffirming i t s policy t o condemn t h e use of weapons a g a i n s t c i v
i l a i r c r a f t i n f l i g h t without prejudice t o t h e provisions of
t h e Charter of t h e United Na t ions ;
Deeply deplores t h e t r a g i c i n c i d e n t which occurred as a
consequence of events and e r r o r s i n i d e n t i f i c a t i o n of t h e
a i r c r a f t which r e s u l t e d i n t h e a c c i d e n t a l d e s t r
u c t i o n of an I r a n A i r a i r l i n e r and t h e l o s s of 290 l i v
e s ;
Expresses again i t s profound sympathy and condolences t o t h e Government
of t h e Islamic Republic of I r a n and t o t h e bereaved f a m i l i e s ;
Appeals again urgently t o a l l Contracting S t a t e s which have n o t y e
t done so t o r a t i f y , a s soon a s p o s s i b l e , t h e Protocol
introducing A r t i c l e 3 - bis* i n t o t h e Convention on I n t e r n a t
i o n a l C i v i l ' Aviation;
Notes t h e r e p o r t of t h e fact-f inding i n v e s t i g a t i o n i n s
t i t u t e d by t h e Secretary General and endorses t h e conclusions of t h
e A i r Navigation Commission on t h e s a f e t y recommendations contained t
h e r e i n ;
Urges S t a t e s t o take a l l necessary measures t o safeguard t h e s a f
e t y of a i r navigation, p a r t i c u l a r l y by assuring e f f e c t i v
e co-ordination of c i v i l and m i l i t a r y a c t i v i t i e s and t h e
proper i d e n t i f i c a t i o n of c i v i l a i r c r a f t .
