TНE COUNCIL OF ICAO ACTS ON IRAN A I R INCIDENT
Montreal, 14 J u l y 1988 -- The Council of t h e I n t e r n a t i o n a l C
i v i l Aviation Organization (ICAO) a t i t s extraordinary s e s s i o n on
13 and 14 J u l y approved by consensus t h e following statement by t h e
President of t h e Council Assad Kotaite:
"1) The Council d u l y considered t h e request by t h e Islamic Republic of
I r a n concerning t h e shooting down, on 3 J u l y 1988, of I r a n A i r
Airbus A300 on f l i g h t IR655;
2) t h e Council expressed profound r e g r e t over t h e l o s s of 290 l i
v e s ;
3 ) t h e Council expressed i t s deepest sympathy and condolences t o t h e
Government of t h e Islamic Republic of I r a n and t o t h e bereaved f a m i
l i e s of t h e victims of t h i s t r a g i c event;
4) t h e Council deplored t h e u s e of weapons a g a i n s t a c i v i l a i
r c r a f t ;
5 ) t h e Council reaffirmed t h e fundamental p r i n c i p l e t h a t S t a
t e s must r e f r a i n from r e s o r t i n g t o t h e u s e of weapons a g
a i n s t c i v i l a i r c r a f t ;
i t a l s o appealed t o a l l S t a t e s which have n o t y e t done s o t o
r a t i f y , as soon a s p o s s i b l e , t h e Protocol introducing A r t i
c l e 3 - b i s i n t o t h e Convention on I n t e r n a t i o n a l C i v i
l Aviation; i t a l s o s t r o n g l y urged a l l S t a t e s t o r e f r a
i n from any a c t i o n which might jeopardize t h e s a f e t y of c i v i l
a v i a t i o n i n t h e a r e a ;
6 ) t h e Council d i r e c t e d t h e Secretary General t o i n s t i t u t
e an immediate f a c t - f i n d i n g i n v e s t i g a t i o n t o determine
a l l r e l e v a n t f a c t s and t e c h n i c a l aspects of t h e chain
of events r e l a t i n g t o t h e f l i g h t and d e s t r u c t i o n of t
h e a i r c r a f t ;
7 ) t h e Council urged a l l p a r t i e s concerned t o co-operate f u l l y
i n t h e i n v e s t i g a t i o n ;
8) t h e P r e s i d e n t of t h e Council and t h e Secretary General should
present a f u l l r e p o r t t o t h e Council as e a r l y as p o s s i b l
e during t h e 125th Session of t h e Council i n September 1988;
9) t h e Council d i r e c t e d t h e P r e s i d e n t of t h e Council and
t h e S e c r e t a r y General :
( a ) t o c o n t i n u e t h e i r e f f o r t s w i t h a l l S t a t e s
concerned f o r t h e e a r l i e s t p o s s i b l e e s t a b l i s h m e n
t o f s u i t a b l e arrangements f o r t h e p r o p e r c o - o r d i n a t
i o n of c i v i l f l i g h t o p e r a t i o n s and m i l i t a r y a c t i
v i t i e s w i t h i n t h e a r e a so as t o f u l l y s a f e g u a r d t
h e s a f e t y of c i v i l a i r n a v i g a t i o n ;
( b ) t o t a k e a l l n e c e s s a r y measures, i n co-operation w i t h t
h e S t a t e s concerned, t o improve t h e r o u t i n g arrangements in t h
e a r e a s o as t o f a c i l i t a t e s a f e o p e r a t i o n of c i v i
l a i r t r a f f i c ;
( c ) t o u n d e r t a k e immediately all n e c e s s a r y s t u d i e s f
o r t h e improvement o f t h e S t a n d a r d s and Recommended P r a c t i
c e s t o p r e v e n t t h e r e c u r r e n c e of s u c h a t r a g i c i n
c i d e n t ;
( d ) t h e P r e s i d e n t of t h e Council and t h e S e c r e t a r y
General should r e p o r t t o t h e Council on t h e implementation o f ( a )
, (b) and ( c ) above as soon as p o s s i b l e . "
